Terms & Conditions SV Member
1) Introduction
This document sets out the Terms of Use (“Terms”) on which Sustainable Venture Development Partners Limited (“SV”) provides services to you (“you”), the individual or the legal entity that enters into these Terms, including without limitation, job applicants looking for a job and applying to a job opening (“Candidates”) on the Website ("Website" or “SV Job Board”) by using this job board (“the Services”) through the Website. We are registered in England and Wales under company number 07660938 and have our registered office at Sustainable Workspaces 5th Floor County Hall, Belvedere Road, London, England, SE1 7PB.
Please read these Terms very carefully before using the Website and the Services. You acknowledge and agree that by using the Website and the Services you agree that you will be bound by these Terms and your acceptance constitutes an Agreement between you and SV. You warrant and represent that you have full capacity and authority to enter into these Terms on behalf of yourself or on behalf of the Company you work for, as applicable. If you don’t agree with any of the terms, you are not permitted to use the Services.
2) Terms and conditions of use
2.1 SV grants to you, subject to these Terms, a limited, non-exclusive right to access and use the Website and the Services to advertise permanent or temporary vacancies by publishing descriptions of permanent or temporary that you seek to fill:
(a) on the Website; and
(b) on to the Workable Job Board (https://jobs.workable.com/) (“Third Party Job Board”).
2.2 You agree that you are solely responsible for any content and the URLs you provide and ensuring that all such information is true, accurate and complete, and provides Candidates with all information required by relevant laws and regulations.
2.3 You hereby authorise SV to publish on your behalf on the Website:
(a) any job listings you have indicated to SV’s administrator; and
(b) re-publish existing job openings you might have already published on another website directly on the SV Job Board.
2.4 You undertake full responsibility for any job opening posted on the Website and for the recruiting decisions you take as a result of any such opening. SV has no responsibility for any employment decisions made by you in regard to any posting on the Website.
2.5 For the purpose of the Conduct of Employment Agencies and Employment Business Regulations 2003 (“Regulations”), we are not an employment business and do not introduce or supply work-seekers to hirers (or vice versa). This means that we do not:
(a) obtain sufficient information for Employers to select a suitable potential candidate for the position which the Employer seeks to fill;
(b) obtain confirmation of the identify of any potential candidates or that they have the experience, training, qualifications or authorization to work in the position to be filled or that they wish to undertake the role to be filled;
(c) take any steps to ensure the Employer and recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the Employer to fulfil the position to be filled;
(d) take any steps to ensure that it would not be detrimental to the interests of the potential candidate for the potential candidate to fulfil the position to be filled;
(e) give any indication to Employers whether potential candidates are unsuitable (or suitable) for any position to be filled in any circumstances;
(f) propose potential candidates to Employers or provide any information about them; or
(g) take up any references in relation to a potential candidate.
2.6 The Regulations seek to ensure that potential candidates are only proposed by employment agencies for roles for which they are properly qualified and that recruiters are only offered potential candidates who have the appropriate levels of experience, training, qualifications and authorization for the position to be filled. Since we are only operating a Job Board and do not propose or introduce potential candidates to Employers or vice versa, it is recommended that you fully ensure a potential candidate’s suitability for the role you are advertising on the Site.
2.7 You represent and warrant that your use of the Website and the Services, including the job postings, their content, any communication with the Candidates and the recruitment process shall at all times comply with all applicable laws and legislation.
2.8 You agree not to transmit or to knowingly or recklessly send material which is, without limitation, obscene, threatening, offensive, defamatory, abusive, untrue, in breach of confidence, or which includes any racist or sexist content or materials. Additionally, you shall not harass any Candidates or advocate harassment, send unsolicited emails or texts and generally contact individuals that have indicated they don't want to be contacted by you.
2.9 You warrant that any such contribution does comply with those standards set out in paragraphs 3.5, 3.6 and any acceptable use policy in effect from time to time, and you are liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
2.10 Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us and the Third Party Job Board a limited licence to use, store and copy that content and to distribute and make it available to third parties.
2.11 We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights or of their right to privacy.
2.12 You undertake full responsibility in relation to the processing of Candidates’ data obtained through the Website for the job postings you publish on the SV Job Board. In this context, you are responsible for informing the Candidates about the processing of their personal information by you by uploading your Privacy Policy including all necessary information about how you collect and process Candidates’ data.
2.13 Crossposting:
(a) By accepting these Terms, you agree that your job postings will be published by default on the Website and Third Party Job Board and you hereby authorise the Third Party Job Board to publish such postings. You may opt out from such crossposting by contacting SV’s administrator or as otherwise indicated via the Services.
(b) You acknowledge that Candidates will have the option to apply directly on the Third Party Job Board, in which case you agree to receive a copy of any such application and Candidate information, in accordance with clause 6.2 below. Crossposting to the Third Party Job Board is also subject to the Third Party Job Board Terms (available at https://jobs.workable.com/terms) and you hereby agree with such terms.
2.14 Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.
3) Data Protection
3.1 SV will collect and process personal data of the users of the Website in accordance with its Privacy Policy, which is an integral part of these Terms. You acknowledge and agree that collection and processing of your personal data is required in order for SV to offer you the Services. SV undertakes that any processing and collection of personal data as required in order to provide the Services is in line with the requirements of the General Data Protection Regulation (EU) 2016/679 and any other applicable legislation (“Data Protection Law”).
3.2 You collect data submitted by a Candidate as a data Controller as defined under Data Protection Law. Your Privacy Policy is applicable in that case to you, the Candidate and the data so provided. SV has no responsibility over the use of such data by you or the Candidate.
3.3 The data submitted as set out in paragraph 3.2 is processed by Workable as your data processor. The provision by Workable to SV of the Jobs Board contains an agreement by them to act as your data processor for these purposes, and accordingly you have a contractual right in place with them as is required by GDPR.
4) Interruptions and omissions in Service
4.1 We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
4.2 SV is not responsible for any errors, omissions, interruptions or delays on the Website and the Services, nor to any third party website or services and has no responsibility for any loss or damages arising from such errors, omissions, interruptions, or delays on the Website and the Services.
5) Control, removal of content and retention
5.1 Unless otherwise explicitly stated by SV, SV assumes no obligation to screen the postings or any material submitted on the Website and cannot be deemed to endorse or approve any postings submitted to the Website by Employers or Candidates. This information and these materials have not been verified by us. The views expressed by other users on our site do not represent our views or values.
5.2 If SV has reason to believe that any information provided by you, including the content provided by you, is not relevant or it breaches or is likely to breach any provision of these Terms, SV at its sole discretion may take any action that it deems appropriate, including without limitation to refuse to publish such content, or delete or edit such content.
5.3 Once a Candidate applies for a job opening on the Website, the application form, including all information provided by the Candidate and any attachments uploaded, will be sent to the Employer.
5.4 Information sent to the Employer will be accessible by the Employer for a maximum period of six (6) months from the date of submission, and after this time, the application and all information provided by the Candidate will be automatically deleted from the system.
5.5 If the Candidate requests to withdraw its application or requests the deletion of its data before the expiry of six (6) months from submission, SV will delete all data from the system upon request. SV has no control over use and storage of your personal information by Employers, including any copies of your CV. Deletion requests should be made to the Employers in accordance with their Privacy Policies.
6) SV’s Liability
6.1 We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: use of, or inability to use, our site; or use of or reliance on any content displayed on our site. In particular, we will not be liable for: loss of profits, sales, business, or revenue;
business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
6.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
6.3 We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
6.4 Please note that we only provide our site for Candidates for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
6.5 If defective digital content that we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
7) Indemnity
7.1 You agree to defend, indemnify, and hold SV, its affiliates, and their respective officers, directors, employees and agents, from and against any loss, liability, claims, actions or demands, including without limitation reasonable attorneys' fees and costs, made by any third party due to or otherwise arising from your use of the Website and the Services, or arising from your breach of any provision of these Terms, including without limitation any intellectual property infringement caused by your content.
7.2 You must notify SV immediately, once you become aware of any third-party claim against you in regard to your use of the Website and the Services.
8) Termination
8.1 These Terms are applicable to you for so long you are using the Website or the Services.
8.2 SV shall be entitled to suspend and/or terminate your access and use of the Services if SV has reason to believe that you have breached any of these Terms, or if SV elects to cease offering the Services. SV may not provide you with notice for any such termination or suspension of the Services.
9) Disclaimer of Warranty
THE SITE AND THE SERVICES ARE PROVIDED ON AN “AS IS” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SV EXPRESSLY EXCLUDES ALL REPRESENTATIONS, WARRANTIES, OBLIGATIONS AND LIABILITIES IN CONNECTION WITH THE SERVICES AND THE WEBSITE.
10) Intellectual Property
10.1 The Website, including all copyright and any other intellectual property in regard to the Website and the Services, is owned by SV, its licensors or any third-party contributors to the Website used by SV.
10.2 You are solely responsible for any and all data, information or any other content that you upload, post, or otherwise provide or store (in connection with or relating to the use of the Services) and for any damages or harms that may arise to others by the use of your content. SV claims no ownership and has no control over your content.
11) Links to other sites
The Website may include links to other third-party Sites, such as Employer sites, recruiting platforms, and general application tracking platforms. SV is not responsible or liable with regards to the content and activities of those sites.
12) Additional Rules
12.1 By using the Website and the Services you agree additionally that you shall not:
(a) modify, translate, create or attempt to create derivative copies of or copy the Website in whole or in part;
(b) take any action that would violate the security of the Website;
(c) reverse engineer, decompile, disassemble or otherwise reduce the object code of the Website to source code form;
(d) distribute, sub-license, assign, share, timeshare, sell, rent, lease, transmit, grant a security interest in or otherwise transfer or assign any rights or obligations under these Terms.
13) Miscellaneous
13.1 The job board is an initiative of SV and Workable (“Workable”), the technology provider. Υour contracting party under these Terms is SV.
13.2 If you already have an active account at Workable, nothing contained in these Terms alters your obligations as a Workable Customer, as provided in the Workable Terms and the Workable Terms are still applicable to you.
13.3 SV and its third-party collaborators, might offer additional services to you, provided you have expressed your interest and agree to any such additional services.
13.4 SV reserves the right to modify these Terms at any time, by revising them on the Website, provided that any such modifications do not materially change the overall functionality of the Services or substantially diminish your rights and obligations. Any changes SV may make to this document in the future will be notified and made available to you via the Website.
13.5 Any notices in relation to the use of the Website and the Services, including any data deletion requests, shall be addressed at SV at the following email: [email protected].
14) Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales and any and all claims, disputes or legal proceedings arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

2) Terms and conditions of use

2.2 You can benefit from the Services by searching for job opportunities and applying to job openings published on the Website by submitting your personal information, such as name, email, education, experience, phone number, and attach your curriculum vitae (CV) or résumé directly to any opening that is of interest to you.
2.3 If you apply to a job opening, you acknowledge that you are sending your personal information to the company that posted the job opening (“Employer”). SV does not have any control over the use of your information by the Employer.
2.4 If you have any concerns in regard to the use of your information by the Employer or if you would like to exercise any of your rights in relation to your personal information once you have submitted your application, you should make a request directly to the company you have applied to.
2.5 You agree that you shall use the Website or the Services, including the submission of any information by you:
(a) only for your lawful personal use to find a job;
(b) in no way in any manner that violates any applicable law;
(c) not to transmit or to knowingly or recklessly receive material which is, without limitation, obscene, threatening, offensive, defamatory, abusive, untrue, in breach of confidence, or which includes any racist or sexist content or materials.
2.6 You are solely responsible for ensuring any information submitted by you is true and accurate, including the information provided in your CV. You are strongly advised not to include any sensitive personal information in your CV.
2.7 We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
2.8 Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for use or available in other locations.
3) Data Protection

4) Interruptions and omissions in Service

5.3 Once a Candidate applies for a job opening on the Website, the application form, including all information provided by the Candidate and any attachments uploaded, will be sent to the Employer.
5.4 Information sent to the Employer will be accessible by the Employer for a maximum period of six (6) months from the date of submission, and after this time, the application and all information provided by the Candidate will be automatically deleted from the system.
5.5 If the Candidate requests to withdraw its application or requests the deletion of its data before the expiry of six (6) months from submission, SV will delete all data from the system upon request. SV has no control over use and storage of your personal information by Employers, including any copies of your CV. Deletion requests should be made to the Employers in accordance with their Privacy Policies.
6) SV’s Liability
6.1 In no event shall SV be liable to you for any damages, any indirect or consequential loss (which are losses incurred as a side effect of the main loss or damage), including without limitation loss of profits, loss of data, loss of reputation, loss of opportunity and any other loss arising out from your use of the Services.
6.2 Where our site contains links to other sites (including Employers) and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.
We have no control over the contents of those sites or resources.
6.3 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
